Clarifications on mandatory compliance with BIS Standards

A new Appendix III to Schedule I of ITC(HS)
Classifications of Export and Import Items, shall be annexed as per annexure
`A' of this Notification.
Import
of all the products as per Appendix III to Schedule I of the ITC (HS)
Classifications of Export and Import Items, shall be subject to compliance of
the mandatory Indian Quality Standards as mentioned in column 2 of the said
Annexure, which are also applicable to domestic goods. For compliance of this
requirement, all manufactures/ exporters of these products to India, shall be required to register themselves with Bureau
of Indian Standards (BIS).
Alternatively
certification of the products under mandatory quality Indian standards will be
permitted under the BIS Product Certification Scheme for Indian importers
provided all the following conditions are met:
a)
Items are required for captive consumption, and
b)
Items are required on continuous basis, and
c)
Items are procured from pre-identified sources.
The
Indian Importers would have to apply to BIS for seeking a licence
for each of the notified product he intends to import. BIS would record the
application after satisfying itself that all the above conditions are met and
that the applicant importer has installed the test facilities. Based on the
recording of application, the Customs can clear the consignment, which will be
tested by the BIS and a licence issued if the product
conforms to the relevant Indian standard. The importer would use the material
only after grant of licence for the first lot so
imported and for the subsequent imports, after testing the product for
conformance to Indian Standard.
The
conditions of Paragraph 6 above shall not be applicable on imports of gifts
where the recipient of a gift is a charitable, religious or an educational
institution registered under a law relating to the registration of societies or
trusts or otherwise approved by the Central or a State Government and the gift
sought to be imported has been exempted from payment of customs duty by the
Ministry of Finance.
Not
withstanding anything contained in the
Appendix III to the Schedule 1 of ITC (HS) Classifications of Export and Import
Items, import of cylinders and import of valves/valve fittings will be exempted
from the conditions at paragraph 6 above. However, this exemption shall be
applicable only on such cylinders, import of which has been approved by Chief
Controller of Explosives, Nagpur. [Amended by DGFT notification 29 dated 28
January 2004]

Note: In terms of General Note 2 (A), as and when BIS notifies an Indian
Standards for new product(s), the import of that product(s) shall conform to
that specified standard from the date of implementation specified for the said
product(s).
B. Clarifications on Mandatory Compliance with BIS
Standards
B1. Packaged Commodity Rules and BIS Standards will
apply independently
[Ref: DGFT Policy Circular No. 34 dated 13 December
2000]
Attention is invited to Notification No. 44
(RE-2000)/97-2002, dated 24.11.2000.
Representations have also been received seeking
clarification whether provisions of the Standards of Weights and Measures
(Packaged Commodities) Rules, 1977, are applicable to only 131 products, listed
in Notification No. 44, on which quality standards have been applied. In this
context, it is clarified that, provision regarding applicability of Indian
Quality Standards on 131 product is an independent
provision. The conditions regarding compliance of the provisions of the
Standards of Weights and Measures (Packaged Commodities) Rules, 1977, will be
applicable on import of all pre-packaged products, as these are applicable on
similar domestically manufactured products.
B2. Clarification on scope of standards will be made
by BIS only and not DGFT
[Ref: DGFT Policy Circular No. 04 dated 19 June 2001]
Attention is invited to Notification No.44
(RE-2000)/97-2002, dated 24.11.2000. Representations/references are regularly
being received from Trade, seeking clarification whether a particular item is
covered under the ambit of Appendix V to the notification No. 44 (list of 133
products). Clarification to the trade and to the customs authorities have been
issued by this office based on the technical comments received from Bureau of
Indian Standards (BIS).
Clarification of this nature (whether any product is
covered within the ambit of notification No. 44 or not, so far as it is
applicable to BIS standards) would only be issued by BIS, and such a
clarification issued by BIS shall be binding on all concerned.
